4.? Listen

Your loved one will likely feel the need to talk about his life and you are helping by simply listening.? He may at times feel angry, ripped off, wishful, sad, happy, satisfied, and scared.? All of these feelings are normal.

5.? Accept Help?

Recognize that you can?t provide everything your loved one needs and that others will feel better if they are able to help.? Let friends and family help where they can, recognizing that not all folks are good at the same things.

  • Some family members may be good at dealing with professionals such as the estate planning attorney, CPA, insurance professional, and financial advisor.
  • Others may work well with the doctors, nurses, social workers, and hospice team.
  • Some may help by cleaning out the garage, while others help by making meals, getting the taxes filed, or running errands.
  • Others may contribute by sitting beside or with physical care.

More feeling upbeat about the economy

After a long, cold winter, the U.S. economy is showing signs of spring, according to recent surveys of consumer and business expectations.

More Americans are convinced the economy will get better than at any time since 2010, a recent survey from CNBC released Wednesday showed. The results echo similar readings from recent surveys of consumer and business confidence.

CNBC?s poll of 836 Americans across the country found that 36 percent believe the economy will improve over the next year, a nearly 10-point gain from November, and the highest level of optimism since 2010. The survey also found growing optimism in two key economic measures: expected wage gains and home prices.

In a separate report Wednesday, a survey of large-company CEOS conducted by The?Business Roundtable, found that corporate managers are also feeling more upbeat about sales, capital spending and hiring for the next six months. In the survey, conducted earlier this month, 128 CEOs boosted their estimates for economic growth this year. They now expect gross domestic product to expand by 2.3 percent in 201012, up from 2.0 percent when the last survey was conducted three months ago.

The Business Roundtable?s survey index, which tracks CEO expectations for the next six months, rose to 96.9 in the latest survey from 77.9 in the fourth quarter of 2011.

Americans said they expect that improved outlook will help boost their paychecks. According to the CNBC survey, Americans expect to see the biggest gains in their paychecks in nearly four years.

They?re also more upbeat about the housing market. Some 22 percent expect their home?s value to increase in the next year, up from 15 percent last quarter and the highest level since December 2010. But 29 percent said their home is worth less than what they paid for it, up from 26 percent a year ago

Those expectations, though, are still lower than they were before the March 2007, just before the Great?Recession began, when about 50 percent expected home values to rise. While Americans believe their wages on average will rise by 2.3 percent in the next year, that figure was 7.3 percent five years ago.

The mood is also tempered by?the higher cost of gasoline and health care. Those concerns were reflected in a separate survey of consumer confidence Tuesday by The Conference Board, which showed sentiment holding steady after gains in recent months ?

?Despite the rally in (stock) prices, the increase in gasoline prices, which are now close to $4 a gallon, has started to take a toll on consumer sentiment," according to Paul Ashworth at Capital Economics.

CNBC?s survey found that 28 percent of Americans say high gasoline prices is their biggest worry, ranking it equal with concern over health care costs. The cost of retirement was a distant third at 14 percent.

A third of the public believes that gasoline prices will remain elevated for longer than four years. Expectations that prices of everyday goods?will rise?are at their highest level in a year.

The improved outlook overall varies considerably depending on household income. About 41 percent of Americans earning more than $100,000 annually expect the economy to improve, but just 32 percent of those earning less than $30,000 share that optimism. That disparity also applies to expectations about wage gains.?Those earning $75,000 or more annually expect their paychecks to rise by 4.1 percent in the next year. Those earning less than $75,000 expect an increase of just 1.1 percent.

    Apple CEO in China mission to clear up problems

    HONG KONG/BEIJING (Reuters) - Apple Inc Chief Executive Tim Cook has jetted into China for talks with government officials as he seeks to clear up a pile of problems in the firm's biggest growth market, from its contested iPad trademark to treatment of local labour.

    Cook is on his first trip to the country since taking over from late co-founder Steve Jobs in August, keeping to a closely guarded agenda that has included talks on Monday with Beijing's mayor and a visit to one of Apple's two stores in the capital.

    "Tim is in China meeting with government officials. China is very important to us and we look forward to even greater investment and growth there," said Carolyn Wu, China spokeswoman for the maker of iPhones, iPads and iPods.

    Wu declined to give details of Cook's full agenda, other than to say he would meet other government officials on Tuesday.

    Cook was photographed smiling by eager fans at the Apple store, who posted some of the images on social networking sites.

    The new chief executive has a thicket of problems to cut through in China, which is both Apple's most important manufacturing hub and biggest potential market.

    China is the world's largest mobile market and already Apple's second-biggest market overall, but the firm has been losing ground there to arch rival Samsung Electronics in smartphones and has yet to introduce the latest version of its top-selling iPad to the country.

    In the last quarter of 2011, Apple captured three quarters of China's tablet PC market, while its iPhone ranked fifth in the country's smartphone sector, industry figures show.

    SCRATCHED THE SURFACE

    Apple has deals in place with China Telecom and Unicom to sell its iPhone in the country, with the only other Chinese carrier, China Mobile, looking to clinch a deal with the California company.

    An alliance with China Mobile, the country's biggest mobile carrier, is viewed by many industry analysts as crucial to the acceleration of iPhone sales through China, though compatibility problems with the carrier's network have yet to be resolved.

    Cook has said that Apple has merely scratched the surface in China as it looks to expand. It has only five stores in the country, though it also sells through more than 100 resellers.

    Apple is also waging a legal battle with a Chinese firm over the local rights to the iPad trademark. The long-running dispute with Proview - a financially weak technology company that claims to have registered the trademark - is making its way through Chinese courts and has threatened to disrupt iPad sales.

    Proview executives declined to comment on Tuesday over whether they will be meeting Cook. No meetings have been set so far between the Apple chief and the Chinese company's lawyers and creditors, sources familiar with the situation said.

    "He should be here to also understand more of the iPad issue and handle the situation," said one source close to Proview.

    Hejun Vanguard Group, a consulting company representing Proview creditors, issued an open letter to Cook on the occasion of his China visit on the trademark lawsuit.

    Proview's creditors said they are overseeing the assets of the loss-making company. Proview Technology (Shenzhen) said earlier in March it was in talks with a creditor that was seeking its bankruptcy.

    "We are willing to fight the trademark case for five, 10 years or even longer," Hejun Vanguard said. "We'll see how long the biggest company in the world can exploit the law and intellectual property rights in China."

    Apple has not launched its new iPad in China yet, so people have been smuggling the new gadget from as far away as the United States and Australia. The new iPad has also been smuggled in from Hong Kong.

    The device hit a hurdle in Australia on Tuesday as the country's consumer regulator accused Apple of misrepresenting the iPad's ability to connect to fast 4G mobile data networks and said it would seek corrections in advertising, and refunds.

    Apple is also reviewing labour standards at the Taiwan firm it uses to assemble its iPhones and iPads, Foxconn Technology Group, which has been accused of running sweatshops in China. The group is the Taiwan parent of Hong Kong-listed Foxconn International Holdings Ltd. and Taiwan-listed Hon Hai Precision.

    At the outset of Cook's visit to China, an activist group based in Hong Kong published an open letter, demanding "that Apple ensure decent working conditions at all its suppliers."

    As the former chief operating officer, Cook helped set up Apple's sprawling supply chain centred on Asia.

    In the open letter, Students & Scholars Against Corporate Misbehaviour, listed grievances cited by employees at Apple suppliers, including "poverty wages" and excessive and forced overtime.

    "They describe their daily routine as work, eat and sleep. They described themselves as machines that repeated the same monotonous motion for thousands (of) times a day," it said.

    "With all its success in the global marketplace, Apple undoubtedly has (the) ability to rectify these problems."

    Apple notes that it has begun releasing labour data monthly, and that it reached 84 percent compliance with its 60-hour work week policy in January, according to a survey of 500,000 workers at suppliers worldwide.

    For February, compliance to the 60-hour work week rose to 89 percent, with the average work week 48 hours, Apple says.

    "That's a substantial improvement over previous results, but we can do better," the company said on its website.

    In my last post, I discussed how monogamy is unlikely to satisfy all of our needs.? I was aware of a few issues tangential to that, but wanted to leave them aside in the interest of keeping posts shorter.? So I will address two issues today; non-sexual friendships and our ability to satisfy needs and desires without relationships.

    ?The Greatest Love of all?

    As I mentioned the other day, in order to have successful relationships, you need to start with yourself.? We need to find where it is possibly, and even preferable in some cases, to find ways to make ourselves happy on our own.

    Surely, there will be many circumstances where there will be overlap between this self-satisfying of desires and our relationships with other people.? Our sexual needs, for example, sometimes can be answered with masturbation and sometimes will require, you know, sex with other people.? Also, there will be times when an emotional challenge can be solved by some serious thinking, reflecting, and evaluation of a situation on our own.? Other times we will need the perspective of others to help us, as often other people see things in us we cannot see.

    We are not island nations, but sometimes our own domestic policy is sufficient for answering to issues of the day rather than appealing to other nations, (or whatever the UN would be in this analogy) for help.

    But the essential point is that when it comes to our needs, simply looking within is a great way to go satisfy them.? Therefore, I encourage everyone to maintain a healthy relationship with the complexity inside our own heads.? I encourage self-love, without getting all hippy about it or something.? Dammit, I think I might be too late?.

    Polyamory as a footnote to Plato?

    ?or at least Platonic friendship.

    Many of the needs we have in our life, complex as they are, do not require finding a sexual partner at all.? The needs which are not satisfied by our partner(s), which are not satisfied by them, do not necessitate finding another romantic or sexual partner necessarily.? Sometimes just a Platonic partner, or friend, is sufficient.

    As I have written about before, polyamory does not require sex to be polyamory.? As a result of this, many people are already polyamorous even if they don?t use the term, or know the term.? Friendships outside of a relationship, especially if they are very close, are so much like what polyamorous people are doing that I often use it as an example of how poly works to people who seem confused by it?s strangeness.? It?s really not that strange.

    If you are in a monogamous relationship, there will be things you want and need to do which your partner does not satisfy.? Whether that is watching sports, going shopping, or getting some drinks on a Wednesday night, our friends fulfill many of our needs which our committed, exclusive, relationship do not.

    Assuming that one partner in a coupling does not interfere with their partner?s friendships, which does happen (and, I think, is due to the same jealousy which makes most people avoid polyamory), those relationships are highly rewarding, meaningful, and important to us.

    Most monogamous people have arrangements just like this, and many of them, in reading this, might be confused why this has anything to do with polyamory.? ?So,? the objector may say, ?why would people need polyamory when we have friends, ourselves, and our one loving partner to satisfy our needs in life?? Well, if these things actually do satisfy your needs, then perhaps we don?t need to be polyamorous. Where I have the problem is that people ignore, repress, or rationalize away other needs they may have in order to maintain monogamy artificially.? My problem is when monogamy is maintained for its own sake, and not for the sake of authenticity and honesty about what we want.

    That is, many people pretend like monogamy+friendship=satisfaction of all needs, when in fact it does not.

    What happens when a friend of ours starts to become someone you are very attracted to? What happens when you develop feelings for a person at your gym, book club, or run into an old flame? Why should we ignore this reality, just because we have a sexual/romantic partner? And if so, why?

    What?s wrong with enjoying sex, safely, consensually, and transparently with other people whether we, or they, are in a relationship?

    What?s wrong with wanting your cake and having it too?

    Nothing.

    Pursuing every desire?

    Yes, there are people out there I am sexually attracted to who I don?t pursue.? I don?t pursue every potential relationship I find, because I recognize that it sometimes there are complexities of desire which are more than I need or want, and so I don?t pursue every desire.

    But sometimes the feelings are too strong, the desire to intense, to ignore.? And depending on how much time I have in my life, I will pursue sexual/romantic partners to various degrees.? Right now, my fiance and my girlfriend take up a lot of my time, so pursuing anything very involved or serious is unwise and unwanted at the moment.? That said, if I really got into someone, I would probably find time, because, well, love is worth the effort.

    But finding a friend with whom I can share a sexual relationship, especially if that desire is two-way, is healthy and available to me.? It does not threaten my relationships to do so, and it brings some pleasure and joy to my life.? Why should I not want and pursue such things?

    Friendships are great, whether they are Platonic or not.? We should allow ourselves to express how we feel about people without artificial censorship or repression because of some strange obsession with maintaining monogamy in our culture.? So keep up your relationships with yourselves, enjoy your friends, and allow yourselves to have the relationships with the people around you as you want, and let ?normal? social expectations and pressures have minimal say in how you do so.

    Escherichia coli ? a bacteria considered the food safety bane of restaurateurs, grocers and consumers ? is a friend. Cornell University biomolecular engineers have learned to use E. coli to produce sugar-modified proteins for making pharmaceuticals cheaper and faster. (Nature Chemical Biology, March 25, 2012.)

    Matthew DeLisa, Cornell associate professor of chemical and biomolecular engineering, and his research team, now have published a novel method for engineering human therapeutic glycoproteins simply and quickly by using E. coli bacteria as a platform. Their methods are now being developed and commercialized through a startup company, Glycobia Inc., which recently took up residence in Cornell's McGovern Family Center for Venture Development in the Life Sciences. While there are no firm plans yet, the professor hopes that within a year, testing this kind of pharmaceutical could be done at the Weill Cornell Medical College in Manhattan.

    Glycoproteins are proteins that are modified at specific amino acid "acceptor" sites with complex carbohydrate structures, or oligosaccharides ? a basic human chemical reaction that's essential to life. That's why specifically designed, genetically engineered glycoproteins are so commonly used as drugs ? they bind to certain protein receptor sites and, for example, block cancer cells from multiplying. Among glycoproteins used to treat diseases today are monoclonal antibodies and interferons.

    Current manufacturing methods rely mainly on costly, time-consuming mammalian culture cells, such as the Chinese Hamster Ovary (CHO) cell line. The process is also susceptible to viral contamination, further driving up production cost. In fact in 2009, another biopharmaceutical company temporarily shut down its plant after such a contamination occurred.

    The Cornell research uses a method to assemble a synthetic pathway for the simple and quick production of a glycoprotein that forms the basis of many of today's therapeutic protein drugs, including, for example, the protein GCase, used in a drug that treats Gaucher's disease. To do so, they artificially introduced the machinery of glycosylation ? the chemical process by which proteins become glycoproteins ? into E. coli cells, rather than animal cells.

    The synthetic pathway they designed, which can be tailored to many amino acid acceptor sites to make different drugs, starts with native enzymes in E. coli. Added to that was a mixture of four enzymes taken from yeast cells, which triggered the biosynthesis of a specific glycan (sugar structure) that resembles the core structure found in virtually all eukaryotic glycans. A fifth enzyme from the bacterium, Campylobacter jejuni, transferred these core glycans to pre-engineered protein acceptor sites, resulting in the desired glycoproteins.

    DeLisa and his colleagues are now working to improve their approach that they call "glycans by design" ? using the enzyme-based protein production method to specifically tailor sugar structures to make many different glycans and glycoproteins.

    In Nicaragua, teachers make only half as much as market vendors

    Since returning to power in 2007, Nicaragua's President Daniel Ortega has championed education as a priority for his administration, and a hallmark of his government?s socialist work.

    Mr. Ortega decreed education free for all, deployed a nationwide literacy campaign, and valiantly declared a ?battle for sixth grade? ? an important goal in a country that has one of the highest dropout rates and lowest high-school enrollments in the world.

    But when it comes to paying the bill for education, the government hasn?t followed through, analysts say, and as a result education is not improving. Not only are textbooks and classrooms outdated, but standards for college admissions are falling and educators are amongst the most underpaid professionals in the country. And the low wages promised to teachers, some say, is telling of the government's true commitment to improving education.

    ?The glass ceiling for the quality of education is the quality of teachers. And there is no way to attract better and more qualified teachers to the profession if people can earn twice as much doing just about any other job,? says Adolfo Acevedo, an economist with the Civil Coordinator public policy and activist group.

    National salaries 'biased against teachers'

    ?The national salary structure?s bias against teachers is overwhelming,? Mr. Acevedo says.

    Not only are Nicaraguan teachers the worst paid in Central America, but they?re also among the worst paid professionals in Nicaragua. In real wage terms, an average public school teacher in Nicaragua earns less than 60 percent of the average wages for other jobs, and only half of what it costs to provide the canasta basica, a list of 56 basic food and household items needed to support an average family.

    Teachers in Nicaragua earn less than miners, factory workers, construction workers, and government functionaries who stand in traffic rotundas waving Sandinista flags at passing cars, according to a comparative study on real purchasing power, Acevedo says. Most teachers earn only half as much as a market vendor.

    ?The average teacher is either living in poverty or right on the verge,? Sandinista analyst Oscar Rene Vargas says.

    Teachers in Nicaragua earn around $185 to $226 a month, according to estimates by Acevedo and Jos? Antonio Zepeda, president of the National Confederation of Nicaraguan Education Workers (ANDEN).

    ?Despite the continuous salary increases over the past six years ? representing a total of 140 percent in wage increases ? teachers still don?t earn enough to meet the costs of the canasta basica,? Zepeda said.

    This is because any salary increase on paper has been virtually cancelled out by inflation and the increases to costs of living, says Acevedo.

    ?The salary increase projected for teachers in 2012 is 9 percent, but inflation is projected to be 7.95 percent,? he says. If projections are correct, the real increase in teacher salaries will be 1.05 percent. ?At that rate of growth, teachers will need to wait 65 years for their salaries to catch up with the average national salary,? Acevedo says.

    Actions speaking louder than words

    ?The deficit in education spending is not a problem that started with this government, but this government has not changed the tendency of underfunding,? says Mr. Vargas. ?The situation is stagnant.?

    Though the Ortega administration has lobbied the World Bank and EU for outside financing to support its education strategy ? a plan Sandinista officials have quietly presented to international donors but kept guarded from any public scrutiny ? the government is hesitant when it comes to opening its own purse strings to pay teachers? salaries, says Mr. Acevedo.

    Ortega, who receives nearly $500 million a year in Venezuelan aid, recently thanked teachers for their ?vocation for service.? But despite his thanks, critics say the Ortega government once again did not do enough to address low salaries for educators in the 2012 budget, which was hurried through National Assembly earlier this month by the Sandinista supermajority.

    The Ministry of Education?s (MINED) department of public relations said they weren?t authorized to give out information about teachers? salaries, and also ignored written requests for information.

    But some say the problem isn?t lack of funding, but how government money is spent.

    That?s only half of what the country should be spending on education, Acevedo says. ?The country needs to establish its priorities.?

    Poor quality of education

    Nicaragua?s cash-strapped school system is amongst the world?s lowest in terms of secondary-school enrollment:? Only 45 percent of students who enter primary school go on to high school.

    Many of those who do make it to high school may not be learning much more than those who drop out, though. The country?s high schools only have enough books to cover 55 percent of the students, something the Ministry of Education blames on a lack of the estimated $6 million needed to print new texts. The ministry hopes the funding will become available by the end of the year.

    Those who do attend high school are not held to education standards or international benchmarks. The country performed so poorly in worldwide standardized testing that it stopped participating in global testing several years ago.

    And according to recent university entrance exams, only 10 percent of students pass the basic math requirements, and 20 percent pass the Spanish-language requirement.? Scores were so low that the National Autonomous University of Nicaragua in Le?n last year lowered the passing grade on its entrance exam to 54 out of 100. But even then, only 68 percent of the high school graduates passed.

    ?There is a lot of government propaganda about education, but the quality of education in Nicaragua still leaves a lot to be desired,? says Carlos T?nnermann, the first Sandinista government?s minister of education and a former member of the UNESCO Director-General?s Advisory Group for Higher Education in Latin America.

      Chambers: Copyright lawyers prepare for new rules | Legal Post ...

      It?s an exciting time to be an intellectual property lawyer in Canada. After several starts and stops, Bill C-11, a.k.a. the Copyright Modernization Act, is well on its way to the Senate. This is the fourth attempt to reform copyright and bring it into the digital age.

      Still, even though it appears to be a done deal at this point, no one seems too happy about it. In fact, significant litigation is anticipated as stakeholders test the limits of the legislation. And intellectual property lawyers who specialize in copyright will clearly play leading roles in determining how the legislation will ultimately be implemented.

      It?s fitting to see who Chambers Global 2012 has ranked as leading practitioners in the intellectual property space, as many of those counsel will be involved in the copyright debates going forward.

      The topic is an emotional issue for many people, says Barry Sookman, a partner with McCarthy T?trault LLP in Toronto and a Canadian authority and blogger on intellectual property law and copyright. In fact, Mr. Sookman was recognized as a Band 2 ranked practitioner for intellectual property law in Chambers Global 2012. McCarthys was ranked as a Band 2 firm in the practice area.

      In addition to copyright affecting individuals in more palpable ways than it ever has, there has also been a very prominent activist agitation about digital issues in the social media, he says.

      ?When you get people all heated up and vexed about copyright and worried about moral panics, there are great divides ? and to some extent that has impeded rational debate,? Mr. Sookman says.

      On one side, creators and rights holders believe the new reforms take away much of their ability to earn a living while giving too much power to the users of their work in the form of expanded fair dealing and user-generated content exceptions. The users of those intellectual works want the Internet to be free and unfettered and are opposed to provisions for new methods of individual enforcement of copyright ? namely digital locks.

      Perhaps appropriately, much of the debate has played out online. Everyone is upset and the blogosphere is on fire with criticisms and concerns.

      Another part of the problem is the fact that there has been no copyright reform since 1997 and now the government is playing catch up. Mr. Sookman provides some background. ?Since 2000, the government has taken a series of important steps to create conditions to promote electronic commerce. It started by introducing privacy legislation to promote confidence in digital networks, then it introduced electronic commerce legislation, and most recently the government passed an anti-spam law again (Legal Post, March 21) to promote the use of the Internet and get rid of hazards.

      ?The one piece that had been missing is copyright. In that context, it?s all an attempt to recognize the world is changing. It?s becoming digital and this Act is an important step to build that framework.?

      From where he sits having represented both rights holders and users, Casey Chisick, a specialist in intellectual property law with Cassels Brock & Blackwell LLP, believes Bill C-11 and its predecessor Bill C-32 are going about it in the wrong way. Mr. Chisick is ranked as a Band 2 practitioner in Chambers Global, while his firm, Cassels Brock, is recognized as Band 4. ?My view is that these bills have eliminated some of the most modern aspects of the Copyright Act we already had and that?s got nothing to do with digital technology,? Mr. Chisick says.

      ?In 1997, in the last major round of copyright reform, the Liberal government of the day introduced a whole series of reforms that facilitated collective administration of copyright. Secondary use of copyright is almost inevitably about a series of highvolume, low-revenue transactions that no individual rights holder could practically manage to track or economically afford to enforce. That?s the function of a collective society. Bill C-11 seriously impairs and reduces the scope of what collective societies such as Access Copyright are able to do for the benefit of their rights holders.?

      As a result, he also believes the government has failed to meet one of its promises with the legislation: to balance the needs of rights holders and users. ?From an individual rights holder?s standpoint, it?s never been more difficult to enforce individual copyright.?

      But given that there is so much intellectual property available on the Internet for free, is copyright protection even possible? ?Of course it is,? Mr. Sookman says. ?If the laws do nothing to help promote the digital exchange for value then it?s a problem. When governments enact legislation that can support the market, the evidence shows that these laws work. Does that mean there is an iron-clad way to prevent all unauthorized file sharing? No. But this is not about getting the very last person to stop file sharing. It?s about giving the creative industries a chance to compete on an even footing because you can?t compete with free.?

      And perhaps the best way to do that, according to Mr. Chisick, is to focus on remuneration versus control. ?The answer I suggest would have been not only to maintain but to expand the availability of collective licensing solutions or alternative methods of compensation for copyright that reduce the scope of individual enforcement or licensing but increase the scope of other ways rights holders can earn money.?

      For his part, Claude Brunet, who chairs the copyright and entertainment team at Norton Rose Canada LLP, is ranked as a Band 3 practitioner for IP law in Chambers Global 2012. The firm is ranked at Band 2. Mr. Brunet agrees with Mr. Chisick and goes on to argue that the government?s objective of trying to achieve a balance of interest between the two stakeholder groups was misguided.

      ?The goal of any copyright act is to organize the marketplace for works of the mind. Speaking on my own behalf and no one else?s, all this Act does is introduce exceptions to copyright protection.? He points to expanded fair dealing exceptions particularly in the area of education that will significantly impact authors and book publishers as an example. ?We are going completely the wrong way,? Mr. Brunet says.

      ?We are choosing control and litigation over a system of seamless remuneration, which we had in place. Bill C-11 creates an environment where the creator and the user are pitted against one another. It?s a piece of legislation that yells, ?So sue me.? We no longer make things. We create works of the mind. If we listen to ISPs and to equipment manufacturers, works of the mind are worth zilch. So what sort of economy are we building here??
