Stem cell research on donor eggs often not disclosed (Reuters)

NEW YORK (Reuters Health) ? Many U.S. fertility clinics don't tell egg donors that embryos made from their eggs may end up being used in stem cell research, according to a new government survey.

That's despite widespread opposition to such research, which is considered morally offensive by a third of Americans, researchers write in the journal Fertility and Sterility.

They found that among 100 fertility clinics, two said they didn't have a consent form for women donating eggs.

Of the 66 clinics that sent in a consent form and said they used excess embryos for research, just 20 told women about that. And only three of 38 clinics that used some embryos for stem cell research in particular disclosed that to donors.

"The survey shows that only a minority of IVF (in vitro fertilization) clinics mention to egg donors who are donating for the sake of treatment (as opposed to research) that resultant embryos might ultimately be used in research," said study co-author Gerald Owen Schaefer of the National Institutes of Health in Bethesda, Maryland. "An even smaller minority mention stem cell research explicitly."

"Since possible research use of embryos, especially for stem cell research, may be material information affecting some women's decision about donation, egg donors should be so informed," he and his colleagues wrote in the paper.

Some women have eggs taken out as part of their own fertility treatment, while others receive handsome payments -- often several thousand dollars -- to donate an egg.

"We recommend that all IVF clinics that provide some embryos for research inform egg donors about the possibility of such research (including stem cell research, which is particularly controversial)," Schaefer told Reuters Health by email. That agrees with several organizations such as the National Academy of Sciences and the International Society for Stem Cell Research.

Bioethicists not involved in the new study questioned whether disclosing that surplus embryos might be used for research would have an effect on women's decision to donate.

"I think it's unlikely that this would have an impact on women who are engaged in commercial egg donation," said Dr. Steven Miles, a professor of bioethics at the University of Minnesota in Minneapolis. "Whether it should be disclosed is another issue -- in general, disclosure is a good thing."

Raymond De Vries, a social scientist and a professor of bioethics at the University of Michigan Medical School in Ann Arbor, said the survey left crucial questions unanswered.

"Clearly it is important for women to know where their eggs are going. But we don't know from this survey, are women upset by this?" he told Reuters Health. "What is missing is, these women who donate eggs, what do you know about them?"

De Vries said there are examples of ads luring in potential donors with compensations upward of $10,000, although harvesting an egg is not a straightforward procedure.

"Getting an egg out of a woman is not like going to the chicken coop and getting an egg," he said. "It is not a completely risk-free endeavor."

Yet, there is no federal regulation of IVF clinics in the U.S., according to De Vries.

"It's cowboy land out there," he said.

Cottonwood High football players team up to help homeless

Cottonwood High School football players teamed up Friday to help the homeless.

The clothing, including 2400 pairs of warm socks and other items, were gathered by Zach Taylor of Highland for his Eagle Scout project.

"They've got stuff to help these guys stay warm in the winter andons of food--looks like good food. They're trying not to eat all the food but they're happy to be here and help out," said Josh Lyman, head football coach at Cottonwood High School.

Santa also came to hand out gifts to the children at the event.

Japan looking to buy Chinese government bonds (Reuters)

BEIJING (Reuters) ? Japan will seek to buy Chinese government bonds, the Japanese government said in a statement issued after Prime Minister Yoshihiko Noda held talks in Beijing with Chinese Premier Wen Jiabao on Sunday.

The statement given to reporters gave no details of when Japan might seek to buy the bonds or on what scale.

Japan had earlier indicated it is in talks to buy Chinese government debt to strengthen economic ties.

Despite sometimes rancorous political ties between the two neighbors, Japan's economic fortunes are increasingly tied to China's economic growth and consumer demand.

China has been Japan's biggest trading partner since 2009.

In 2010, trade between the two nations grew by 22.3 percent compared to levels in 2009, reaching 26.5 trillion yen ($339.3 billion), according to the Japan External Trade Organization.

China and Japan are also the world's first and second-biggest holders of foreign reserves.

The Recording Academy has announced it plans to award a posthumous Trustees Award Grammy to Apple co-founder Steve Jobs to recognize his role in revolutionizing the modern music industry.

???A creative visionary, Jobs??? innovations such as the iPod and its counterpart, the online iTunes store, revolutionized the industry and how music was distributed and purchased,??

Apple was indeed a pioneer in the digital music retailing business, launching its iTunes store in 2003 with the support of all major record labels after much arm-twisting from Steve Jobs to get them all to agree to uniform pricing (then $0.99 per track), with the concession that all tracks were protected with Apple?s FairPlay DRM technology. The iTunes Store was greeted with some skepticism?after all, why buy digital tracks when CDs were often cheaper (especially for albums) and a vast library of pirated music was easily available (illegally) via peer-to-peer file sharing services? However, fueled by its iPod personal music player business, the iTunes Music Store turned into a strong success for Apple?although the store now has differential pricing, most tracks are now sold without DRM protection?another move Apple was early to embrace. As a result, Apple has long been the leading music retailer, leaving the likes of Walmart and Amazon in its wake.

Apple was also the recipient of the first Grammy ever awarded to a PC company?back in 2002 when Apple was still considered a ?PC company.? The Recording Academy is granting two other Trustees Awards this year, one to longtime producer/songwriter/big-band leader Dave Bartholomew (who wrote and produced for the likes of Elvis, Chuck Berry, and Fats Domino), and world-famous recording engineer Rudy Van Gelder, who virtually defined the warm, full-textured sound associate with many high-quality jazz recordings?if you love the Blue Note jazz catalog, Ruby Van Gelder is the guy who made it happen.

Cricket LTE goes live in Tucson, introduces the Huawei Boltz

Leap Wireless, the Cricket folks, told us we can expect to see LTE service go live in Tucson before the end of the year -- and by golly, they were bound and determined to do it. Sure 'nuff, the prepaid carrier is now ready to match wits against MetroPCS as it brings its first 4G market and device live with just ten days remaining in 2011. At least 90 percent of Tucson will be able to enjoy the faster speeds, with nearby Nogales, AZ receiving some expansion love sometime in 2012 and at least two-thirds of its countrywide network benefiting from the next-gen service within the next two to three years. Its first LTE device is the Huawei Boltz -- also known as the Huawei E397 in other parts of the world -- and can be bought for $150 with no contract. Eventually, Leap says, the lineup will be expanded to include smartphones and tablets. Now, let's talk pricing: two data plans of 5GB each are available, with $50 getting you download speeds of 3Mbps and $60 offering you 6Mbps. Granted, this is nothing compared to the ultra-fast speeds you see on Verizon and AT&T's LTE networks at the moment, but it's a start.

Newt Gingrich's Unusual Ideas About Space and Science (Time.com)

The busy mind of Newt Gingrich has been much in the news lately. He's the man of grand ideas ? a thinker, a theorist, the big brain in a GOP field of bureaucrats and simpletons. Don't believe it? Don't worry; Gingrich himself will tell you.

Gingrich's mind indeed does churn. The problem is, he approaches ideas the way a gluttonous gourmand approaches food ? with a rich, complex and subtle appetite but also a hopeless weakness for corn dogs and Twinkies. If it's edible ? or, in his case, imaginable ? he's interested. This can be awkward, particularly when he steps outside his comfort zone of history and public policy and starts to muck around with science. (Watch "10 Questions for Newt Gingrich.")

Much has been made of some of Gingrich's wackier ideas in the past few weeks, beginning with his oft repeated worry that a rogue state with a nuclear weapon could shut down the U.S. power grid. To give Gingrich his due, there's a grain of truth in his fears. Scientists agree ? theoretically, at least ? that a missile detonated at the right altitude could trigger what's known as an electromagnetic pulse (EMP) that could fry the circuits of whatever country lay below. The one experiential data point that supports this idea occurred in 1962, when an atmospheric test of an American atomic weapon caused street lights in Hawaii to go temporarily dark.

Of course, it's a big step from that to shutting down an entire country, especially when the bad actors Gingrich imagines blacking out America are the Iranians and North Koreans, who have nowhere near the missile technology or targeting know-how to pull off such a stunt ? at least without being detected ? and in the case of the Iranians, don't even have a bomb yet. What's more, if either country did want to launch a strike, it would be a whole lot easier to go the point-and-shoot route: pick a city and try to take it out directly. Yet Gingrich has continued to sound the EMP alarm, arguing that preparing for such an attack should be an important part of the country's defense posture.

"In theory, a relatively small device detonated over Omaha would knock out about half the electricity generated in the United States," he warned in Iowa last week, according to the New York Times.

Gingrich's advocacy of space mirrors ? albeit years ago, in a 1984 book ? has provoked an eye roller too. The thinking is that scientists could position giant mirrors in space that would point toward Earth, reflecting sunlight downward and creating as much illumination as several full moons. This would eliminate the need for nighttime lighting on highways and serve as a deterrent to crime by brightening shadowy neighborhoods. Put aside what this would do to the day-night cycle under which all life on Earth is accustomed to operating; put aside what it would do to the simple business of looking up and trying to see a star. The technical obstacles are dizzying. The U.S. has already orbited one whopping-big mirror ? a slab of polished glass inside the Hubble Space Telescope that measures close to 8 ft. (2.4 m) in diameter. But reflective space mirrors would have to be far bigger, perhaps the size of a football field. Even the massive International Space Station, which measures 357 ft. (109 m) across, appears to be little more than a moving star at the lowest point of its orbit, 234 miles (376 km) above ground. To provide permanent illumination to a target area, you'd have to position your mirrors a whole lot farther away ? in geosynchronous orbit, 22,236 miles (37,786 km) above sea level, so that their rate of revolution would match the rotation of the globe.

The weight problem alone makes this impossible ? at least if you are trying to fly a giant mirror made of glass, like the Hubble's. While University of Arizona engineers have developed mirror material only 0.04 in. (1 mm) thick, this doesn't address other problems, like the cost of launching and maintaining the mirrors, not to mention keeping so big a target safe from meteors and other space debris. All of this seems to be an awful lot of trouble to go to for an illumination problem that highway lights and porch lamps already solve rather neatly.

It's Gingrich's advocacy of moon mining, however, that is getting the most attention ? and drawing the most derision ? partly because it's a drum he doesn't seem willing to quit banging. For the most part, the moon is a pretty prosaic mix of very familiar materials, including silicon, iron, calcium, aluminum, potassium and phosphorus. There is, however, also helium-3. A light isotope of common helium, helium-3 streams toward Earth all the time as part of the storm of charged particles coming from the sun, but our planet's magnetic field deflects most of it. This is not so on the moon, which has a magnetic field far weaker than Earth's. What makes this important is that helium-3 also turns out to be a crackerjack fuel for fusion reactors ? far more efficient than the deuterium currently used. But it's not just a matter of going to the moon, scooping up what you need and powering the world on it. (Watch TIME's video "Earth Is Running Out of Helium.")

First of all, a practical fusion reactor has not yet been invented, and there's no realistic projection for when one might be, though scientists have been trying for decades. What's more, the moon's helium-3 is not just there for the taking. Apollo samples revealed that the isotope is present in lunar soil in concentrations no greater than 30 parts per billion. Harrison Schmitt, the lunar-module pilot on Apollo 17 and the only geologist to walk on the moon, estimates that it would take 220 lb. (100 kg) of helium-3 to power a city the size of Dallas for one year and that to collect that much, you'd have to dig a trench 0.75 miles square by 9 ft. deep (1.9 sq km by 2.7 m).

That's a lot of digging, and it doesn't even touch the cost of getting the stuff home. Even aboard cheap rockets like the Russian Proton, it costs $2,200 to launch a pound of payload to low-Earth orbit. The shuttle, nobody's idea of a bargain ship, cost $8,100 per lb. Things are a lot cheaper on the moon, where lower gravity means everything weighs less, but that doesn't mean every ounce doesn't cost a lot. There's a reason the skin of the Apollo lunar module was no thicker than three sheets of aluminum foil and that its windows were triangular ? a shape that shaved a few ounces off the framing and sealant that would have been needed for round windows of approximately the same size.

In the latest presidential debate, Gingrich responded to Mitt Romney's criticism of the moon-mining concept by not responding. "I'm happy to defend the idea that America should be in space and should be there in an aggressive, entrepreneurial way," he said ? which most people agree with and which is not what Romney was questioning at all.

Answering evasively, of course, is what politicians do, as is dreaming big dreams of New Frontiers and Great Societies and shining cities on hills. But dreams aren't science ? and politicians, for the most part, aren't scientists. Newt Gingrich may play one on TV, but that doesn't mean anyone is required to listen.

Salesforce Moves into Human Capital Management with Rypple (NewsFactor)

Not content to shake up the CRM market alone, Salesforce.com is moving into a new social-software sector with its latest acquisition. Salesforce has acquired Rypple, a cloud-based social-performance management company, for an undisclosed amount.

With the Rypple assets and talent, Salesforce is entering the human capital management market for the social enterprise. Salesforce will relaunch Rypple as Successforce and create a new HCM division run by John Wookey, executive vice president of advanced applications at Salesforce. The company expects Rypple's tech to also bolster the value of its core products.

"As we developed Chatter, we started thinking more about how we could deploy the concept of social-networking platforms to different business processes and how it could have a huge potential impact on outcomes of those business processes," Wookey said. "The opportunity with Rypple was serendipitous."

A Social-Goals Revolution

The rumblings of a HCM software shakeup have been getting louder over the past couple of years as companies like WorkSimple and Rypple emerged on the scene with social-goals platforms. Traditional HCM software was designed for a generation of workers 30 years ago when the goal was reducing the cost and risk of employing people.

Salesforce believes the modern workforce demands new performance and leadership tools that are completely transparent and allow employees to be connected to their company's mission and each other. Apps from Rypple and WorkSimple, among others, allow for goal setting, feedback, recognition and continuous dialog to help employees align more effectively around the company mission.

"We took the science of team performance and applied the collaborative, transparent, and real-time power of social networks to create a completely new model for managing people and the work they deliver," said David Stein, co-CEO and co-founder of Rypple. "Salesforce.com gives us the opportunity to apply our expertise and extend our vision for Rypple with Successforce."

Mission-Critical Human Capital

Wookey expects the Rypple acquisition to drive Salesforce.com's suite of social products. The company plans to embed some of Rypple's next-generation features into its existing products. For example, people will be able to thank colleagues, win badges and provide recognition -- all from within Salesforce Chatter. And customers of core Salesforce products -- the Sales Cloud, Service Cloud, and Force.com platform -- will be able to connect with new employee feedback tools to help drive business goals and power the future of their employee social networks.

"We had always planned to begin with the business processes that are most critical, which are you onboard and manage employees in a way that aligns what they do every day with the objectives of your company and the mission of the enterprise," Wookey said. "Rypple has credibility with enough customers, and a proven model that works, as well as a team of people who understand the HCM space."

Answer: Find That Trail [Search Research]

Answer: Find That TrailGoogler Daniel Russell knows how to find the answers to questions you can't get to with a simple Google query. In his weekly Search Research column, Russell issues a search challenge, then follows up later in the week with his solution?using whatever search technology and methodology fits the bill. This week's challenge: Find that trail!

Quick answer: One end of the trail is here, near 13456 S Fork Ln, Los Altos, CA 94022 (or, lat/long: 37.376390, -122.16103). And after reading through some of your comments, I was able to find the other end of the trail on Edgerton Rd.

Here's what I did to find it.

I kept thinking it was a "trail" so I kept searching for a trail map that had "Wallace Stegner trail" on it.

That turned out to be a bit of a dead end. It's partly because Los Altos Hills calls their system of trails "pathways" rather than trails. I picked up that useful factoid by reading about Los Altos Hills trails and stumbling across an article that mentioned their "system of pathways."

Once I did a search for [ "Wallace Stegner pathway"] and it returned only 5 hits (and one of which is broken with a 404 error). Luckily, the link to SF Gate article about Wallace Stegner's house being demolished was good enough.

The key piece of data to take away from this is this sentence:

"It [the trail] starts on Three Forks Lane where the narrow path alongside Matadero Creek near the Stegner property. "

Elsewhere in that article it gives the Stegner home address at 13456 South Fork Lane, Los Altos Hills, CA. (Note: Wallace passed away a few years ago and the residence has changed hands.)

If you look at the Google map for that street address, you can see that the obvious nearby watershed is named "Matadero Creek." And if you use Google Streetview to "walk" down the street to the place where the creek crosses the road, you'll quickly find that location, here.

Now, to tell the truth, even though I was THERE, because of the complications of the hills where I'd been running, I really didn't know where the official start of the trail was. So this result surprised me.

Now, my next task... to find the other end.

Since I know that the trail is part of the official city "pathway system," I just did [site:losaltoshills.ca.gov wallace stegner pathway] to limit my search to the official city publications and that gave me the city newletter, "Our Town" from 2009. In that newletter it says:

"...Wallace Stegner Path from Three Forks Lane to Edgerton Road, named for the world famous author who lived for many years just uphill from that path."

It wasn't hard to use StreetView to find the other end on Edgerton Rd.

Note that the first part of the sign was blurred-out by the algorithm that blurs out license plate numbers. For some reason, it thinks part of this sign is a license plate.

To be sure, I tried following the trail on the Maps view, and I even tried Google Earth, hoping to get better resolution. But the trail is obscured by heavy trees, and I couldn't follow it reliably. Luckily, the city put up those handy markers to let me find it!

Now... I have to point out that many readers found the Wallace Stegner Memorial Bench located up in the Long Ridge Open Space Preserve at lat/long: 37.278778, -122.160767 It turns out that I've gone running up there too, and it's NOT on the Wallace Stegner trail (or pathway), and it's definitely NOT in Los Altos Hills (as I said in the original challenge). It's actually on Long Ridge Road (a fire road / trail).

Former flight attendant sentenced for plane fire

A former flight attendant who his lawyer claims wanted to be a hero when he set fire to an airplane bathroom and then helped put out the blaze was sentenced Friday to more than six years in prison.

Investigators originally said that Eder Rojas, 23, formerly of Woodbury, Minn., started the fire because he was unhappy about working the Compass Airlines route from Minneapolis to Regina, Saskatchewan. Defense attorney Richard Henderson disputed that claim Friday and said his client has a narcissistic personality disorder.

"I don't think he understands what fully motivated him to do this," Henderson said.

Both explanations are irrational and extreme, U.S. District Judge Ralph Erickson said.

"It could have been an unmitigated disaster," Erickson said. "Really, that's all I can say about the offense. The real issue is do we get him the psychiatric help he needs."

Prosecutors said earlier that about five weeks before the Compass flight, Rojas was aboard another flight that was forced to make an emergency landing in Wisconsin because of a bathroom fire. Rojas allegedly helped put out the fire. No charges have been filed in that case.

Assistant U.S. Attorney Brett Shasky said Friday that Rojas could have created a fireball on the Compass plane because of the oxygen on board. "It would have been one big boom," the prosecutor said. The pilot had "visions of passengers on fire before that plane got to ground," Shasky said.

The plane was forced to make an emergency landing in Fargo. No injuries were reported among the 72 passengers and four crew members, but Shasky cited letters from people aboard the plane who said they have been traumatized by the incident.

"Several indicated they are absolutely terrified to set foot on a plane now," Shasky said.

The government said Rojas brought a lighter aboard the flight and used it to set fire to paper towels in the rear bathroom. Rojas reportedly asked for extra paper towels before the plane took off from Minneapolis.

A tearful Rojas said Friday he was sorry for what he did and would accept any punishment he received.

"It was selfish of me. I was just thinking of me, myself and I," he said. "I hope the passengers can forgive me for what I did."

Rojas faced a maximum penalty of 20 years in prison. Erickson sentenced him to 74 months and ordered him to pay back more than $100,000, most of that to Compass Airlines for damage to the bathroom and accommodations for passengers.

Rojas, who was 19 at the time he was arrested, was charged with starting a fire aboard an aircraft and failure to appear. The latter charge, which was dropped Friday, was filed after he walked away from a Fargo halfway house in September 2008 and fled to Mexico. He was arrested on March 26 in Iguala, Guerrero, Mexico. He pleaded guilty in September.

Erickson said Rojas did not truly accept responsibility for the crime.

"You ran away, you had to be extradited," Erickson said. "I'm not going to reward that behavior today, tomorrow, or ever."

Euro, Europe stocks fall on lack of Fed action (Reuters)

LONDON (Reuters) ? The euro hit an 11-month low against the dollar and stocks eased on Wednesday after the Federal Reserve warned Europe's sovereign debt crisis could hurt the U.S. economy but failed to signal fresh action to stimulate growth.

Euro/dollar slumped to its lowest level since January at $1.3005 as investors also speculated that more euro zone nations may be hit with debt downgrades in the near term given that a quick solution to the region's crisis remains elusive.

"If we get a further deterioration of the euro zone debt crisis, if we see a lot of countries being downgraded, or more problems in the banking sector, this $1.30 is not going to hold," said Arne Lohmann Rasmussen, chief analyst at Danske in Copenhagen.

The dollar index (.DXY), which tracks the dollar's value against a basket of currencies, rose as high as 80.407.

Markets have been sliding since the start of the week as investors increasingly take the view that measures agreed at last week's EU leaders summit did not go far enough to resolve the two-year-old debt crisis.

European shares fell, tracking Wall Street lower with the key FTSEurofirst 300 (.FTEU3) index down about 0.7 percent. The heavyweight banking sector, strongly exposed to the euro zone crisis, lagged. The STOXX Europe 600 Banking Index (.SX7P) fell 0.9 percent.

"There was a bit of expectation in the market yesterday about the Fed (announcing stimulus)," said Jeremy Batstone-Carr, strategist at Charles Stanley.

Global stocks as measured by the MSCI world equity index (.MIWD00000PUS) extended their losing streak into a third straight day with the index now down over 3.6 percent in the past month.

DEBT SALES EYED

Debt markets were on edge ahead of a planned sale in Rome of up to 3 billion euros of new 5-year bonds - Italy's first sale of longer-term debt since the European Union took steps towards greater fiscal integration last week.

The benchmark five-year bond yield was volatile, rising above 7.00 percent before easing to 6.76 percent, and poor demand at the sale may send 10-year Italian bond yields towards lifetime highs having already climbed above the 7.0 percent level considered unsustainable.

Germany will offer 5 billion euros of new 2-year bonds, and may struggle to attract demand after yields marked new euro-era lows this week after the ECB cut interest rates last week.

Although a five-year Bund auction last week saw strong demand, three out of four of the country's previous auctions drew less bids than the amount on offer.

Credit Eases for Small Business Owners Seeking Capital

The economy is at last starting to show signs of recovery. Consumer confidence surged in November to its highest level since July, an indication that Americans may be more willing to spend. Holiday shopping figures for Black Friday and Cyber Monday were robust. The government jobs report on December 2nd announced that unemployment had fallen to 8.6 percent, its lowest level in 2 1/2 years.

I am seeing a growing number of small business owners registering on our platform for funding. This is a good sign. Meanwhile, credit has loosened in the past month. This has been a trend for most of the second half of 2011.

The big story continues to be the growth of small business lending by credit unions, which granted 57 percent of small funding requests last month. Overall, alternative lenders ? credit unions, as well as Community Development Financial Institutions (CDFIs), microlenders and others ? approved 62 percent of funding requests, a rise from 61.8 percent during October.

Loan approvals by smaller banks jumped to 47 percent in November. Meanwhile, big banks, which have the most stringent lending criteria, approved 10 percent of small business loan requests for the first time since April. Here is a closer look:

Republicans block Obama appellate court nominee (AP)

WASHINGTON ? Senate Republicans on Tuesday blocked President Barack Obama's nominee to the U.S. Court of Appeals in Washington, partly as payback for the Democrats' past opposition to Republican nominees.

Republicans portrayed Caitlin Halligan as a liberal activist, while Democrats argued she had outstanding qualifications for the seat that has been vacant since John Roberts was elevated to the Supreme Court.

The vote was 54-45, short of the 60 votes needed under Senate rules to break a filibuster.

Halligan is general counsel in the Manhattan district attorney's office and formerly was the New York State solicitor general.

The Republican opposition reignited the furious political debate over judicial nominations, just as the issue had appeared to slightly calm down the past several months. Since September, the Senate confirmed five of President Obama's appellate nominees ? four of them unanimously ? and 19 U.S. district judges.

Obama, in a statement, said he was "deeply disappointed" with the "Republican pattern of obstructionism that puts party ahead of country. Today's vote dramatically lowers the bar used to justify a filibuster."

He added that Senate Republicans "are blocking 20 other highly qualified judicial nominees, half of whom I have nominated to fill vacancies deemed `judicial emergencies' by the Administrative Office of the Courts."

This wasn't the first time Republicans have blocked an appellate nominee this year. Last May, Democrats fell short of the 60 votes needed to end a filibuster against Goodwin Liu as the nominee for the San Francisco-based 9th U.S. Circuit Court of Appeals. He's now on the California Supreme Court.

Sen. Charles Grassley, R-Iowa, ranking Republican on the Senate Judiciary Committee, said "there is a lot at stake with nominations to this (D.C. Circuit) court" because its judges have frequently been considered ? and elevated ? to the Supreme Court. Halligan is 44.

Grassley then launched into the partisan history of the Republican attempt to fill the seat after Roberts left the District of Columbia appellate court.

President George W. Bush in June 2006 nominated Peter Keisler, who served as a top Justice Department official and for a time was acting attorney general.

"Mr. Keisler was eminently qualified to serve on that court," Grassley said. "He had a distinguished academic and professional record. Despite his qualifications, Mr. Keisler waited 918 days for a committee vote, which never came."

Grassley said six of Bush's nominees, including Roberts, endured "delays, filibusters, multiple hearings, and other forms of obstruction."

He contended that Halligan signed a report by New York City's bar association panel that objected to military detentions of suspected terrorists. Grassley said Halligan had a role in state lawsuits "attempting to hold handgun manufacturers liable for criminal acts committed with handguns."

Sen. Charles Schumer, D-N.Y. warned, "The approach taken by Senate Republicans will have lasting consequences beyond this one."

He said this filibuster was likely the final blow to a 2005 agreement by 14 senators ? 9 still serving ? to only filibuster judicial nominees under extraordinary circumstances. In the Liu nomination, several Republicans argued he was so liberal that extraordinary circumstances were present.

But while Democrats acknowledged Liu's liberalism, they argued that Halligan's positions were in the mainstream.

The Senate Judiciary Committee chairman, Sen. Patrick Leahy of Vermont said, "This should be a consensus nomination, not a source of controversy and contention." He said letters of support from prominent individuals "attest to the fact that she is not a closed-minded ideologue, but is the kind of nominee who has demonstrated not only legal talent but also a dedication to the rule of law throughout her career.

"Concocted controversies and a blatant misreading of Ms. Halligan's record as an advocate are no reason to obstruct this outstanding nomination," Leahy said.

The only Republican to break with her party and support ending the filibuster was Sen. Lisa Murkowski, R-Alaska.

She said that judicial nominees deserve an up-or-down vote except in extraordinary circumstances. She added, "I did not support Ms. Halligan's candidacy and would never have voted for her confirmation."

Craigslist ad victim? Police identify another body

CLEVELAND -- Authorities identified the body of an Ohio man Saturday who could?be the third victim of a bogus Craigslist website ad that lured two jobseekers to their deaths.

The body of Ralph?H.?Geiger, 56,?was found in a shallow grave Nov. 25 in the same area another body was found earlier in the month in the heavily wooded area in southeastern Ohio, Noble County Sheriff Steve Hannum said.

Hannum, under a gag order from a judge, did not say whether Geiger answered the same ad promising farmhand work that authorities say led to the deaths of two other men.

"Recent events of an ongoing investigation led authorities to Mr. Geiger's gravesite," Hannum said in a statement.

The body of Geiger, whose last known address was Akron, Ohio, was the third found in Ohio that might be linked to the Craigslist ad.?

A South Carolina man, Scott Davis, survived a shooting attack in rural Noble County, Ohio, on Nov. 6 when he answered an ad looking for a ranch hand. Davis was shot while running away from two men he met when he responded to the ad.

One of the three bodies was found in a shallow grave on Nov. 15 near where Davis was shot; it was identified as David Pauley, 51, of Norfolk, Virginia. A second body was found in a shallow grave on Nov. 25 behind a semi-deserted mall in Akron, Ohio.

The third body, Geiger's, was also discovered?Nov. 25. A coroner's report released on Saturday said Geiger died of a gunshot to the head. No date of death was given but the report said the body was moderately decomposed. Geiger's family was notified.

After Davis survived the attack, 16-year-old Brogan Rafferty was arrested and charged with attempted murder and murder in juvenile court. His next hearing is Dec. 15.

Another man named by the FBI as a suspect in the shooting, Richard J. Beasley, 52, is in prison in Summit County, Ohio, on unrelated drug and prostitution charges.

The phony ad was posted on Craigslist Oct. 7 and offered $300 a week to "simply watch over a 688 acre patch of hilly farmland."

The case is under a gag order issued from a judge in Noble County, Ohio but the sheriff's office said they found Geiger's grave site through the ongoing investigation.

There have been several instances in recent years of attackers allegedly finding victims through postings on the classified ad website Craigslist.

In 2009, a former medical student was accused of killing a masseuse he met through Craigslist, and police have been hunting for at least one serial killer in the New York area thought to prey on prostitutes who advertised on the site.

Nigeria anti-gay marriage bill risks AIDS funding (AP)

LAGOS, Nigeria ? A bill originally designed to outlaw gay marriage in Nigeria likely has consequences far beyond its initial scope ? criminalizing gay groups and organizations could jeopardize millions of dollars of Western aid geared toward stopping the spread of HIV and AIDS in Africa's most populous nation.

Though an oil-rich nation, Nigeria likely cannot afford to scorn foreign aid in the fight against HIV/AIDS, experts say. Nigeria has the continent's second highest number of people living with the disease, says the United Nations. More than 3 million people are infected with the disease and many do not know their status, according to U.N. estimates.

"There are about 400,000 people on anti-retrovirals in Nigeria at the moment and 95 percent of those are paid for by donor funds," Nigerian public health physician and health blogger Chikwe Ihekweazu told The Associated Press.

Gay sex has been banned in Nigeria, a nation of more than 160 million people, since colonial rule by the British. Gays and lesbians face open discrimination and abuse in a country divided by Christians and Muslims who almost uniformly oppose homosexuality. In the areas in Nigeria's north where Islamic Shariah law has been enforced for about a decade, gays and lesbians can face death by stoning.

Under the proposed law passed by Senate this week, couples who marry could face up to 14 years each in prison. Witnesses or anyone who helps couples marry could be sentenced to 10 years behind bars. The bill also punishes the "public show of same-sex amorous relationships directly or indirectly" with ten years in prison.

A newly added portion of the bill, leveling 10 years in prison for those found guilty of organizing, operating or supporting gay clubs, organizations and meetings, worries advocates in Nigeria. They fear the law could be used against groups providing aid for HIV and AIDS outreach programs that traditionally consider gay men as an at-risk group.

"We work with them trying to reduce their risk factors, trying to make them more healthy and have safer sex practices," said Meyiwa Ede of the donor-funded public health organization Society for Family Health. "If we can't work with them anymore, then they are vulnerable."

But lawmakers playing to the deeply religious nation's dislike of gays and lesbians have said donor nations who threaten to cut aid over the bill can keep their assistance, putting at risk the lives of people reliant on anti-retroviral drugs.

The U.S. and U.K. governments funnel huge sums of money into Nigeria for AIDS and HIV outreach. The U.S. government, under the United States' President Emergency Plan for AIDS Relief, has given an average of $308 million dollars a year to groups working in HIV prevention, treatment, and support, according to the U.S. Consulate in Lagos.

The U.K. government spends an average of $31 million dollars a year on HIV/AIDS programs in Nigeria, the Abuja office of the U.K.'s Department for International Development said.

Through local partners, the funding reaches heterosexuals, as well as gays and lesbians to combat the spread of HIV and AIDS. Heterosexual sex accounts for 80 percent of HIV transmissions in Nigeria, said the country's National Agency for the Control of AIDS in a recent report.

U.K. Prime Minister David Cameron recently threatened to cut aid to African countries who discriminate against gays and lesbians. Advocates fear that could include the HIV and AIDS funding.

Statements from the U.S. and U.K. say both governments are watching the bill closely, but declined to comment further on how it may affect their outreach.

President Goodluck Jonathan promised the United Nations General Assembly in June that his administration was "committing to increase national ownership of HIV and AIDS responses" and to make those responses inclusive. However, six months later, little has changed in a country that makes no attempt to reach gay and lesbian communities.

Nigeria's Health Minister Onyebuchi Chukwu told AP that the bill outlawing gay groups would not affect state-funded HIV and AIDS programs if it were to become law. The health ministry has no programs specifically targeting these communities, said spokeswoman Rekia Zubairu.

Rights groups say the lawmakers' resolve to pass the bill reflects widespread homophobia in Nigeria, but it also shows their disconnect from working-class Nigerians, regardless of their sexual orientation.

"They have the resources to go abroad for treatment, with their big salaries, so they don't give a hoot about ordinary people," gay rights organizer Dorothy Akenova said. "The majority of Nigerians are the ones who will suffer for it."

The bill must still be passed by Nigeria's House of Representatives and signed by President Jonathan before becoming law.

GMAC ends most Mass. mortgage lending after suit (AP)

NEW YORK ? One day after it was among five major banks sued by Massachusetts over deceptive foreclosure practices, GMAC Mortgage says it will stop purchasing new mortgage loans written by third parties in the state.

The mortgage origination and servicing arm of Ally Financial Inc. says it will honor all commitments with correspondent lenders and wholesale brokers through Monday.

GMAC will continue to lend directly to homeowners in Massachusetts. Most of its business in the state is done through third parties like community banks, which originate loans and sell them to GMAC.

GMAC then handles the loan servicing, or collecting homeowner payments.

The suit claims GMAC and other banks violated Massachusetts law with "unlawful and deceptive" conduct, including unlawful foreclosures, false documentation, robo-signing, and deceptive practices related to loan modifications.

Germany's Merkel fights for euro, Cameron for UK (Reuters)

PARIS/BERLIN (Reuters) ? British Prime Minister David Cameron threatened on Friday to obstruct a Franco-German drive for swift change to the European Union's treaty intended to help save the euro.

After talks with French President Nicolas Sarkozy, Cameron said he was not convinced treaty change was needed to reinforce the single currency zone, which Britain has refused to join. If the 27-nation bloc's charter were reopened at a crunch summit next week, he would have his own agenda.

The British leader said euro zone institutions such as the European Central Bank needed to "get behind the currency" to convince markets that it had the required firepower, and member states had to make their economies more competitive.

"Neither of those things require treaty change, but if there is treaty change I will make sure that we further protect and enhance Britain's interests," he told reporters. There was no immediate comment from Sarkozy's office.

Cameron faces pressure from Eurosceptics in his Conservative party to loosen Britain's ties with the EU and secure guarantees that any move towards fiscal union on the continent does not harm the interests of the City of London financial centre.

Sarkozy tried to persuade him to allow stricter budget discipline procedures for the euro zone without insisting on returning powers over social and judicial affairs from Brussels to London or seeking a veto right over EU financial regulation.

German Chancellor Angela Merkel called earlier for rapid but limited treaty change to remedy what she sees as the root causes of Europe's raging sovereign debt crisis, warning that Europeans faced a "marathon" to regain lost credibility.

Outlining a long-term approach to tighter fiscal integration in the single currency area, with tougher budget discipline, she dismissed quick fixes such as massive U.S.-style money printing by the European Central Bank or issuing joint euro zone bonds.

"Resolving the sovereign debt crisis is a process, and this process will take years," Merkel told parliament, vowing to defend the euro, which she said was stronger than Germany's former deutschemark.

The chancellor will travel to Paris on Monday to outline joint proposals with Sarkozy for treaty changes to create coercive powers to reject national budgets and impose automatic sanctions on serial deficit sinners.

Next Friday's EU summit is seen by some as make-or-break for the euro zone after a string of half-measures agreed too late by European leaders over nearly two years have failed to stop bond market contagion spreading from Greece to Ireland, Portugal and now Italy and Spain.

Sources close to Merkel said she was willing to see the ECB step up buying of troubled euro zone countries' bonds, alongside smart use of the bloc's rescue fund, as a bridging measure until budget controls took hold, but she did not see it as a lasting solution.

Her speech set the agenda for a week of intense diplomacy to try to frame a new political deal to restore market confidence and give the ECB grounds to act more decisively to defend the euro and support teetering banks.

BREAKUP SCENARIOS

World stocks and European bonds continued to gain on hopes that euro zone leaders may be moving closer to a comprehensive solution to the debt crisis.

But in a sign that business leaders are beginning to doubt whether the currency will survive, the chief executive of Austrian energy group OMV said dozens of top European executives were working on post-euro contingency plans.

"I was recently in Paris with some other representatives of large companies and we discussed this question," Gerhard Roiss told reporters on Friday when asked if he had plans for a euro breakup. About half the 45 firms present had confirmed they were working on such scenarios.

ECB President Mario Draghi sent a crucial signal to markets on Thursday, opening the door to more aggressive action to help fight the euro zone's sovereign debt and banking crisis if governments adopted a new "fiscal compact."

Sarkozy embraced German calls for a new treaty tightening fiscal discipline in a policy speech in Toulon on Thursday, but in contrast to Merkel, he made no mention of greater powers for the European Commission and European Court of Justice.

Instead, the French leader, struggling to win re-election next May, called for an "intergovernmental" Europe in which the presidents and prime ministers of euro zone countries would be the ultimate arbiters over national budgets.

His socialist opponents denounced him for advocating an "austerity treaty" dictated by Germany. Merkel went out of her way to rebut such accusations, telling the Bundestag it was "misleading" to suggest Germans were trying to dominate Europe.

The president of the European Parliament, Jerzy Buzek of Poland, warned that treaty change could be "dangerous" because Europe's citizens were unlikely to warm to the idea in the near future.

MARKETS RECOVER

EU diplomats said Paris and Berlin hoped to find agreement among all 27 member states for limited treaty amendments rather than having to take the more divisive route of drafting a separate blueprint for the 17 euro zone states or fewer.

German officials praised the conservative Sarkozy's courage in telling voters, in what the business daily Handelsblatt called a "blood, sweat and tears speech," that France would have to overhaul its social model and cut public spending.

Peter Altmaier, chief whip of Merkel's conservatives in the Bundestag, told German radio: "We have so far managed to fix a German-French position on all the important decisions on Europe in recent months. I am very confident that we will be able to reach a common position with our French friends by the summit next week. There is much more uniting us than dividing us."

On the markets, German 10-year Bunds outperformed safe-haven U.S. Treasuries and British gilts as investors saw prospects of an EU summit deal and ECB action to ease funding for cash-starved banks and to counter a looming recession in Europe.

Italy's 10-year bond yield was down to 6.65 percent, well below the danger levels close to 8 percent they hit last week, which analysts said could make it impossible for Rome to refinance its debt next year. Spain's 10-year borrowing cost tumbled to 5.68 percent.

Sentiment has turned more positive since the world's major central banks took emergency joint action on Wednesday to provide cheaper dollar funding for European banks, a move which suggested they feared a funding crunch was imminent.

A key measure of dollar funding stress felt by euro zone banks, the three-month euro/dollar cross currency basis swap, which shows the rate charged when swapping euro interest rate payments on an underlying asset into dollars, has narrowed by 30 basis points since the coordinated central bank move to around minus 130 bps.

The basis swap was at its widest since end-2008 -- at the height of the global financial crisis -- before the central banks' move.

Senate clears way for passage of big defense bill (AP)

WASHINGTON ? Senate Democrats and Republicans are pushing for harsher sanctions against Iran's Central Bank as fears of Tehran developing a nuclear weapon outweigh concerns that any step would drive up oil prices and hit Americans at the gas pump.

The Senate on Wednesday weighed whether to add the sanctions measure to a massive, $662 billion defense bill that moved closer to passage. A vote on the sanctions was likely Thursday.

On Wednesday, lawmakers voted 88-12 to limit debate on the legislation, and looked to wrap up the bill by week's end.

The legislation would authorize funds for military personnel, weapons systems, the wars in Iraq and Afghanistan and national security programs in the Energy Department. The bill is $27 billion less than what President Barack Obama requested for the budget year beginning Oct. 1 and $43 billion less than what Congress provided to the Pentagon this year.

Tougher sanctions against Iran have widespread support in Congress, reflecting concerns not only for U.S. national security but ally Israel's as well. Last week, the Obama administration announced a new set of penalties against Iran, including identifying for the first time Iran's entire banking sector as a "primary money laundering concern." This requires increased monitoring by U.S. banks to ensure that they and their foreign affiliates avoid dealing with Iranian financial institutions.

But lawmakers pressed ahead with even tougher penalties despite reservations by the administration.

Sens. Bob Menendez, D-N.J., and Mark Kirk, R-Ill., offered an amendment to the defense bill that would target foreign financial institutions that do business with the Central Bank of Iran, barring them from opening or maintaining correspondent operations in the United States. It would apply to foreign central banks only for transactions that involve the sale or purchase of petroleum or petroleum products.

The sanctions on petroleum would only apply if the president determines there is a sufficient alternative supply and if the country with jurisdiction over the financial institution has not significantly reduced its purchases of Iranian oil.

Lawmakers cited the recent International Atomic Energy Agency report that Iran is suspected of clandestine work that is "specific to nuclear weapons," its alleged role in the plot to assassinate the Saudi ambassador in the United States and the attack on the British Embassy in Tehran.

"One of the greatest threats to our nation and our ally Israel is Iran," Menendez said, insisting that the United States must take steps to prevent Iran from developing a nuclear weapon.

"We cannot, we must not and we will not let that happen," Menendez said, "but the clock is ticking."

Kirk said the amendment was clear: "If you do business with the Central Bank of Iran, you cannot do business with the United States."

The administration harbors concerns about the enforcement of the measure, which has more than 80 backers in the Senate. Denis McDonough, White House deputy national security adviser, held a closed-door Capitol Hill meeting with several senators on Tuesday, including Kirk and Menendez.

After the session, Kirk sought to allay concerns about rising gasoline prices.

"I've had detailed conversations with Saudi Arabia's ambassador to the United States, who described a great willingness by Saudi Arabia to increase (oil) production," Kirk told reporters.

A vote on the amendment was expected on Thursday.

The Senate approved dozens of amendments by voice vote on Wednesday. Among them:

_Linking funds for the Pakistan Counterinsurgency Fund to a requirement that the Obama administration certify to Congress that Pakistan is trying to counter improvised explosive devices.

_Calling on the president to devise a plan, with input from the military and NATO, for accelerating the withdrawal of U.S. forces from Afghanistan.

_Seeking an urgent intelligence assessment of Libya's stockpile of about 20,000 portable anti-aircraft missiles and the threat they pose to the United States and its allies.
